Here's the skinny direct form the Skokomish Public Safety and Fisheries office; if you are on the indian side of the river on any dry land you are in violation and subject to a ticket.
Last year the tribal police were giving fishermen the benfit and allowing them to fish and stand on the gravel bar; not any more.
Fishermen be aware; it's a hefty fine!

Perhaps they're learning from their brethren up north and enjoying virtual immunity from the rule of law. Courts? Laws? Rules? We don't need no steeking badges...

The skinny for the Skokomish tribal leaders is that:
1. They don't own the gravel bars on the north side of the river that are exposed when the tide goes out.
2. Their officers can be arrested for interfering with a lawful sport fishery off reservation/tribal lands.

Tribal officers can be arrested by whom for interfering with a lawful sport fisherman? With as many people as fish the Skok, albeit not as many fishing lawfully, I'd expect there'll be a lot of confrontations if tribal police exceed their authority.

LE if they are knowingly conducting illegal activities are not immune from the law. In this case the Skokomish LE are not on reservation or tribal lands or waters but clearly on public land or waters. They are interfering with a lawful sport fishery by their actions...a gross misdemeanor.

This issue has been resolved. Skokomish tribal council is now fully aware that they have jurisdiction only to the boundaries of the reservation which is the ordinary high water line of the river on the north side. You won't see any tickets for trespass unless you do trespass above that line. Accessing the river from the north side through reservation uplands will get you a ticket.

The reservation was all on the North side of the river until they bought the Bourgault property.

Bourgalt property on the south side of the river is not part of the reservation but it is tribal property. They can post the land just like any owner of private land above the high water mark on that side as the state lists the river as navigable and retained ownership of the river bed. They can block access across that parcel but cannot keep you from walking the river bed.

You would think that this would set some sort of precedence for the problems everyone has with property and ownership disputes on river access.

It doesn't apply to every river...in many cases the upland owner does own the river bottom and the river is not navigable .
It also doesn't allow people to trespass to get to the river.
